These Terms of Use govern access to bramptonlandscaping.ca, use of its content and forms, and requests submitted through the website. By using the website, you agree to these terms.
1. About the website
Brampton Landscaping provides general information about landscaping, outdoor construction, property maintenance, commercial property care, and snow and ice services in Brampton. The website also allows users to submit questions and quote requests.
The website may be operated with an authorized landscaping contractor or property-service provider that receives and responds to requests. The identity of the contractor, scope of work, credentials, insurance, pricing, and contractual terms must be confirmed before services begin.
2. Informational content only
Website content is general information. It is not a site assessment, final design, construction drawing, engineering opinion, survey, arborist report, drainage plan, permit approval, legal advice, safety advice, or guarantee that a particular solution is suitable for a property.
Photos, diagrams, descriptions, measurements, material discussions, bylaw summaries, and project examples must not be used as a substitute for inspection by a qualified person. Property conditions and municipal requirements can differ and can change over time.
3. Quote requests do not create a contract
Submitting a form, receiving an automated confirmation, discussing a project, or arranging a site visit does not create a contractor-client relationship and does not require either party to proceed. A binding service agreement exists only when the parties accept a separate written quote or contract containing the applicable scope and terms.
A final agreement should address, where relevant, scope, exclusions, measurements, preparation, removals, materials, substitutions, access, utilities, permits, payment, deposits, taxes, scheduling, weather, delays, cleanup, warranties, change orders, cancellation, and dispute procedures.
4. Service availability and estimates
Services shown on the website may not be available for every property, season, project size, or requested date. Availability depends on operator capacity, access, weather, site conditions, required qualifications, materials, equipment, and project fit.
Any preliminary range, verbal discussion, or website description is not a final price. Quotes can change before acceptance if measurements, site conditions, disposal requirements, material choices, taxes, permit requirements, utility conflicts, or the requested scope changes. The written quote or contract controls if it conflicts with general website content.
5. Your submissions and responsibilities
You agree to provide accurate, current, and complete information and to update material details before work is confirmed. You are responsible for having authority to request work at the property and for identifying owners, tenants, condominium rules, property-management requirements, easements, boundaries, shared features, access restrictions, pets, hazards, known drainage issues, underground systems, and existing approvals that may affect the work.
You must not submit confidential information that is unnecessary for a quote. Do not upload identification documents, financial credentials, medical records, unlawful content, malware, or files that infringe another person’s rights.
6. Photos and uploaded material
You retain ownership of photos, documents, and text you submit. You grant Brampton Landscaping and the authorized service operator a limited, non-exclusive right to store, copy, review, and share that material only as reasonably needed to process the request, assess the project, prepare a quote, provide service, maintain records, or comply with law.
Submission does not grant permission to use a customer’s photos or project as public marketing. Separate permission should be obtained before identifiable customer property, testimonials, or project media are published for promotional purposes.
7. Property conditions, permits, and utilities
Landscaping work can be affected by grading, drainage, soil, frost, trees, structures, property lines, easements, municipal rules, conservation requirements, condominium rules, utility locations, and permit requirements. Unless a written contract states otherwise, the property owner is responsible for confirming ownership boundaries and obtaining approvals that legally remain the owner’s responsibility.
Required utility locates, professional reviews, permits, inspections, and approvals must be completed before affected work begins. Nothing on the website authorizes driveway widening, drainage changes, tree removal, excavation, electrical or gas work, structural construction, or any other regulated activity.
8. Snow, weather, and emergency limitations
Weather-dependent services are subject to changing conditions, municipal plow activity, accumulation, temperature, access, and written service triggers. General website language does not guarantee arrival or completion within a specific time.
The website and its forms are not monitored as an emergency service. Do not rely on them for urgent flooding, dangerous ice, fallen utilities, fire, gas leaks, medical emergencies, or immediate threats to people or property. Contact the appropriate emergency service or utility provider.
9. Acceptable use
You may use the website only for lawful personal or business inquiry purposes. You must not:
- Submit false, misleading, fraudulent, threatening, discriminatory, defamatory, or unlawful material
- Upload malicious code or attempt to bypass security, rate limits, or access controls
- Use automated tools to scrape, copy, overload, probe, or disrupt the website
- Impersonate another person or submit their personal information without authority
- Reuse website text, images, branding, or code for commercial republication without permission
- Use the website in a way that violates law or another person’s rights
10. Intellectual property
Unless otherwise stated, the website design, branding, logo, text, graphics, code, and original content are owned by or licensed to Brampton Landscaping and are protected by applicable intellectual-property laws. You may view and print reasonable portions for your own project planning. No ownership rights are transferred.
11. Third-party services and links
The website may rely on or link to third-party forms, maps, analytics, social networks, municipal pages, suppliers, and other services. Third parties control their own content, availability, security, accessibility, privacy practices, and terms. A link does not guarantee endorsement or accuracy.
12. Disclaimer of warranties
To the extent permitted by law, the website and its general content are provided on an “as is” and “as available” basis. We do not warrant that every page will be complete, current, uninterrupted, error-free, or suitable for a particular project. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
13. Limitation of liability
To the extent permitted by law, Brampton Landscaping and the website operator are not liable for indirect, incidental, special, consequential, or punitive loss arising solely from use of, inability to use, or reliance on general website content. This limitation does not apply where liability cannot be limited by law and does not replace the liability terms in an accepted service contract.
14. Privacy
Personal information submitted through the website is handled according to the Privacy Policy. The policy explains collection, use, disclosure, service providers, retention, safeguards, and privacy choices.
15. Changes, suspension, and availability
We may update content, correct errors, change features, limit abusive use, or suspend the website for maintenance or security. These terms may also be revised. The version posted when you use the website applies to that use; an accepted service contract is governed by its own amendment rules.
16. Governing law
These website terms are governed by the laws of Ontario and the applicable federal laws of Canada. Subject to any mandatory consumer rights or dispute rules, disputes relating only to website use will be brought before a court of competent jurisdiction in Ontario.
17. General provisions
If a provision is found unenforceable, it will be limited or removed only to the extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. These terms, together with the Privacy Policy, form the agreement governing website use and do not replace a separate written service contract.
18. Contact
Questions about these terms can be submitted through the website contact form. Include “Terms of Use” in the subject or message so the request can be directed appropriately.
